SMS/Text Messaging Terms and Conditions

ClinicianCore is a platform owned and operated by Healthcare Provider Network, Inc.

These SMS/Text Messaging Terms and Conditions (“SMS Terms”) govern the SMS/text messaging services provided by Healthcare Provider Network, Inc. (“Healthcare Provider Network,” “ClinicianCore,” “we,” “us,” or “our”).

These SMS Terms apply to individuals who voluntarily enroll in ClinicianCore SMS/text messaging services.

By opting in to receive SMS/text messages from ClinicianCore, you acknowledge that you have read and understood these SMS Terms and consent to receive the applicable messages described below.

  1. Opt-In and Express Consent

By providing your mobile telephone number to ClinicianCore and affirmatively opting in to receive SMS/text messages, you provide your consent to receive informational and service-related SMS/text messages from ClinicianCore at the number provided.

Your consent to receive SMS messages is not a condition of purchasing goods or services.

You represent that you are the subscriber of the mobile telephone number provided or that you are otherwise authorized to provide consent for that number.

You may withdraw your consent at any time using the opt-out process described below.

  1. Purpose of SMS Messages

ClinicianCore SMS/text messaging is intended to provide informational, security, account, and service-related communications associated with ClinicianCore services.

Depending on your account, settings, and use of the Services, messages may include:

  • Account security notifications
  • One-time passcodes and authentication codes
  • Account activation or verification notifications
  • Password reset or account-recovery notifications
  • Notifications regarding activity associated with your account
  • Notifications that a new secure communication may be available within the ClinicianCore platform
  • Collaboration or workflow notifications
  • Service availability or maintenance notifications
  • Important service-related notices
  • Notifications concerning changes to applicable terms or policies

No Marketing Messages

ClinicianCore does not use this SMS program to send promotional or marketing messages.

If ClinicianCore offers a separate promotional or marketing SMS program in the future, that program will require a separate opt-in where required by applicable law.

  1. SMS Is Not a Secure Clinical Communication Channel

SMS/text messaging is used by ClinicianCore primarily for notifications, authentication, and other service-related communications.

ClinicianCore SMS is not intended to replace the secure communication functionality provided through the ClinicianCore platform.

Users should not intentionally send Protected Health Information (PHI), confidential clinical information, or other sensitive information to ClinicianCore through ordinary SMS/text messages.

Where a notification relates to a secure communication, users should access the applicable information through the authorized ClinicianCore platform or application.

  1. Message Frequency

Message frequency varies depending on:

  • Account activity
  • Security events
  • Authentication activity
  • Service activity
  • Notification preferences
  • Applicable platform settings

For example, an authentication message may be sent when you attempt to sign in or complete a security-related action.

You should not expect a fixed number of messages per day or month.

  1. Message and Data Rates

Message and data rates may apply to SMS messages sent by ClinicianCore and to messages sent by you.

ClinicianCore does not control wireless carrier charges.

Please contact your mobile service provider for information about applicable messaging or data charges associated with your mobile plan.

  1. How to Opt Out

You may opt out of ClinicianCore SMS messages at any time.

To stop receiving SMS messages, reply:

STOP

to the number from which you are receiving messages.

After receiving your opt-out request, ClinicianCore may send one final message confirming that your request has been processed.

After your opt-out request has been processed, you will no longer receive messages from the applicable SMS program, except where a message is necessary to process your request or as otherwise permitted or required by applicable law.

If you later wish to receive SMS messages again, you may re-enroll through an available ClinicianCore enrollment or account-management process.

  1. Help

For assistance with the ClinicianCore SMS program, reply:

HELP

to the number from which you are receiving messages.

  1. Changes to Your Mobile Number

If your mobile telephone number changes, you are responsible for updating your information through the applicable ClinicianCore account or enrollment process.

You should not enroll a telephone number that you do not own or are not authorized to use.

ClinicianCore is not responsible for messages delivered to a telephone number that you have provided or failed to update.

  1. Privacy

ClinicianCore’s collection, use, disclosure, retention, and protection of information associated with SMS communications are governed by the ClinicianCore Privacy Policy.

ClinicianCore does not sell personal information, PHI, or consumer health data.

Information associated with SMS communications may be processed by ClinicianCore and authorized service providers as reasonably necessary to provide authentication, notifications, communications, security, and other requested or necessary services.

Where applicable, such processing is subject to appropriate contractual and organizational safeguards.

The Privacy Policy also describes applicable information regarding:

  • Personal information
  • PHI
  • Consumer health data
  • Service providers and subprocessors
  • Security
  • Data retention
  • Data deletion
  • Privacy rights
  • Applicable privacy requests
  1. SMS and Protected Health Information

ClinicianCore’s SMS service is designed primarily for notifications and service-related communications, rather than the transmission of clinical information.

Where an SMS notification relates to information available within the ClinicianCore platform, the message may direct the recipient to access that information through the appropriate authenticated ClinicianCore service.

Users should not reply to SMS messages with PHI or other confidential clinical information.

Healthcare organizations and users remain responsible for following their own privacy, security, communication, and information-governance policies.

  1. Third-Party Messaging and Wireless Providers

ClinicianCore may use authorized third-party communications providers or infrastructure providers to facilitate SMS delivery.

These providers may process information necessary to deliver SMS messages, including telephone numbers, message-routing information, delivery information, and related technical information.

Such providers are subject to applicable contractual and organizational requirements.

SMS delivery is also dependent on wireless carriers and telecommunications networks that are outside ClinicianCore’s direct control.

  1. Message Delivery

ClinicianCore works to provide reliable SMS delivery but does not guarantee that every message will be delivered immediately or successfully.

Message delivery may be affected by:

  • Wireless network conditions
  • Carrier availability
  • Device settings
  • Phone number accuracy
  • Network congestion
  • Service outages
  • Geographic limitations
  • Other circumstances outside ClinicianCore’s reasonable control

Wireless carriers are not responsible for delayed or undelivered messages to the extent permitted by applicable law.

  1. Account and Service Communications

Certain communications may be necessary to operate, secure, or maintain your ClinicianCore account.

Opting out of SMS communications may prevent you from receiving some SMS-based notifications or authentication messages.

Where available, alternative communication or authentication methods may be provided through ClinicianCore services.

  1. No Emergency Service

ClinicianCore SMS/text messaging is not an emergency communication service.

Do not rely on ClinicianCore SMS for emergency medical care, emergency response, or time-critical clinical intervention.

For emergencies, use the appropriate emergency communication and response procedures applicable to your location and organization.

  1. Security

ClinicianCore maintains administrative, technical, and organizational safeguards designed to protect information associated with its services.

Security measures may include, depending on the applicable service and functionality:

  • Authentication controls
  • Access management
  • Monitoring
  • Audit and accountability controls
  • Security safeguards
  • Incident-response procedures
  • Administrative and organizational safeguards

SMS itself is a telecommunications service and should not be considered equivalent to the secure communication environment provided through the authenticated ClinicianCore platform.

  1. Relationship to Other ClinicianCore Terms

These SMS Terms should be read together with the applicable ClinicianCore policies and agreements, including:

  • ClinicianCore Terms of Use
  • ClinicianCore Privacy Policy
  • ClinicianCore Security & Compliance policy
  • Applicable Business Associate Agreement
  • Applicable customer, subscription, or service agreement

Where a separate written agreement applies to your use of ClinicianCore services, that agreement will govern to the extent of any conflict.

  1. Changes to These SMS Terms

ClinicianCore may update these SMS Terms from time to time to reflect changes in:

  • SMS services
  • Technology
  • Messaging practices
  • Security practices
  • Legal or regulatory requirements
  • Business operations

When material changes are made, ClinicianCore may provide additional notice where appropriate or required by applicable law.

The updated terms become effective when posted or on the effective date specified in the updated terms, as applicable.
